TERMS AND CONDITIONS OF SALE

1.     Applicable Law: This sale will be conducted according to the laws of the State of Michigan. All sales are final.

2.     Procedure of Sale: Horses are available for inspection during the Preview Sessions: Thursday, August 19, 6 pm to 9 pm; Friday, August 20, 10 am to 12pm and 2 pm to  5 pm; Saturday, August 21, 10 am to 1 pm. Private inspections must be arranged by appointment with Auction Staff and conducted in the presence of Auction Staff. HGF will provide radiographs for each horse.  HGF encourages Buyers to obtain the services of the veterinarian of their choice for inspection of horses. Auction will be conducted at 4.00 pm on Saturday, August 21. Bids will be accepted live (in-person and phone bidding), on-line and via absentee bidding. Changes to the procedure of this auction are at the discretion of HGF and will be announced if necessary.

3.     Bidding Procedure: Bidding will take place both online (pre- bidding) and onsite live and online via satellite on August 21^st.  Buyers may register to bid at www.jkbid.com to bid online (real time via satellite or pre- bids) or in person on Auction Day at Hampton Green Farm (for live bidding).  Highest bidder must be the Buyer. All agent’s must notify the Auctioneer and Settlement Office in advance and present a notarized letter of authorization signed by their client(s). Absentee Bids or those paying with Check must have payment method approved in advance (see Terms of Payment below). The Auctioneer reserves the right to accept and/or reject any bid. The Auctioneer’s decision will be final.

4.     Disputes: The Auctioneer reserves the right to accept and/or reject any bid.  If a dispute arises between two or more bidders, the dispute will be handled by the Auctioneer at the Auctioneer’s discretion. 

5.     Title and Delivery: Buyer assumes all risk and responsibility for the horse at the fall of the hammer. Delivery and title to horse shall pass to Buyer upon payment. Buyer must make full payment for horse by cash, credit card, or cashier’s check within 60 minutes of conclusion of the sale according to these Terms and Conditions, at which time ownership papers will be handed over and delivery will be made in the form of a stable release. No horses will be released until all funds have cleared. HGF strongly encourages Buyer to arrange for immediate insurance coverage for horse.

With the exception of foals, all sold livestock must be removed from the premises within 24 hours of the sale. Short-term boarding may be arranged with HGF at $100.00 per day. Foal boarding until weaning requires a signed Foal Board agreement with HGF at $50.00 per month.

            HGF will not release any horse until the bid is paid in full, according to the Terms and Conditions of this sale. During this time or any extended stay of sold horses, neither HGF Staff, Auction Staff, Consignors, Hampton Green Farm, Kimberly Boyer, or any employees, officers or agents of the above, will be liable for any accidents, theft, disease or sickness, death or injury, or damage to any horse howsoever caused. HGF Staff and only HGF Staff will continue to care for horses until loaded by Buyer into transportation vehicle without any contractual relationship being entered into between HGF, its Auction Staff, officers, employees, agents, grooms, representatives and/or authorized Consignor, its officers, agents, employees, grooms or representatives.

6.     Terms of Payment: A 10% Buyer’s Premium above and beyond the hammer price will be charged on each and every horse. Michigan Sales Tax may apply. Cash or Cashier’s Check or Credit Card Charge will be accepted for payment, with a 3% Service Charge applied to all Credit Card purchases. Make all Cashier’s Checks payable to Hampton Green Farm. Buyers must make payment within 60 minutes of close of Sale for the full purchase price plus applicable taxes, fees and premium. Personal checks will be accepted only if arrangements have been made with the Business Office prior to the sale, including a Letter of Credit from the Buyer’s Bank. Title and Delivery of horse will not be made until all funds have cleared. Buyer may not stop payment on a check given in payment for a horse or subsequent services for any reason. HGF reserves the right to ask for immediate payment for any purchase made at this Sale.  Any Buyer who fails to make immediate payment when requested shall forfeit all rights to acquire ownership to that particular purchase and further shall relinquish rights to further bidding at this auction. Any horse that is not paid for when requested may be re-entered into the sale or re-sold privately by HGF.

7.     Default: Any Bidder registering (either online or in person) and placing a bid will be held responsible for completing the purchase.  Any bidder that places a bid and does not complete the purchase will be in default.  JKBID.COM /or Hampton Green Farm will take any action necessary to satisfy the debt of a default bidder, including legal action. The Auctioneer reserves the right to sell that purchase on the Buyer’s account without prior notice and reserves the right to litigate with the Buyer for any deficit, including but not limited to purchase price, premium, board, vet bills, farrier bills, and any and all legal expenses involved.

8.     Warranties: Buyer accepts delivery of an HGF Top Ten Auction Horse on an as is where is basis. Hampton Green Farms and its Agents make no warranties or representation whatsoever, express or implied, with respect to the HGF Top Ten Auction Horse, including warranties concerning the physical condition, health, or soundness of HGF Top Ten Auction Horse, or warranties or representations with respect to the merchantability or fitness of HGF Top Ten Auction Horse for any particular purpose, all of which warranties or representations are hereby specifically excluded. Buyers acknowledge that he/she will conduct such investigations and inspections, including the use of a qualified veterinarian, as he/she deems appropriate.

9.     Liability and Indemnity—Public and Private: Neither the Consignor, Hampton Green Farm, nor it’s auctioneers, officers, employees, agents or representatives, nor JKBid.com nor it’s officers, employees, agents or representatives assume any responsibility for theft, fire, or other damages, or any injury, death or damage to person or animal of any kind howsoever caused. Attend event and inspect horses at your own risk. The public is cautioned to be extremely careful while on the grounds of HGF and inspecting horses. All children must be accompanied by an adult at all times—no exceptions. Do not enter stalls under any circumstances! During the Exhibition and Sale, absolutely no Buyer or Spectator will be allowed into the barns under any circumstances. Persons wishing to inspect a young horse must do so during posted Preview Sessions and by appointment, accompanied by Auction Staff at all times. Absolutely no smoking on the HGF grounds.

Buyer, or Buyer’s agent, agrees to assume full responsibility for HGF Top Ten Auction Horse as of date of sale and will waive, release, and discharge any and all claims and liability against Hampton Green Farms and/or Kimberly (Van Kampen) Boyer for damage of any kind to anyone, including sickness or injury or death, resulting from any cause whatsoever in regards to HGF Top Ten Auction Horse.

Bidders may register to bid online at www.jkbid.com or in person at the auction site on August 21^st. 

Online Registration:  Bidders will be required to provide full name, address, phone number, and credit card information and/or Bank Letter of Credit. 

In Person Registration:  Bidders will be required to provide positive ID (Driver’s License), address, and phone number, credit card information and/or Bank Letter of Credit.  Please read carefully the Terms and Conditions of Sale. Registration confirms Buyer’s agreement with Terms and Conditions.

2.     All Preview inspections must be made by appointment and conducted with Auction Staff in attendance.

3.     Do not enter stalls for any reason. HGF Auction staff will assist you in inspecting and handling the horses.

4.     There will be no private sales of HGF Top Ten Auction Horses prior to the public sale on August 21. HGF may need to substitute an entry in the case of a veterinary issue. In the case of a substitution, all information will be provided at time of sale.

5.     Horses will be sold in order of age, starting with foals.

6.     Please review Payment information: Payments made by credit card will include a 3% service charge. Cash and Cashier’s Checks are accepted. Personal Checks are accepted with a Certified Letter of Credit from Bank. See Registration above.

7.     10% Buyers Premium will be charged. Buyers must familiarize themselves thoroughly with the Terms and Conditions of Sale.

Hampton Green Farms recommends that Buyer obtain mortality and medical insurance for HGF Top Ten Auction Horse effective at date of sale.

9.     Buyer, or Buyer’s agent, agrees to assume full responsibility for HGF Top Ten Auction Horse as of date of sale and will waive, release, and discharge any and all claims and liability against Hampton Green Farms and/or Kimberly (Van Kampen) Boyer for damage of any kind to anyone, including sickness or injury or death, resulting from any cause whatsoever in regards to HGF Top Ten Auction Horse.

10.                        PREVIEW/INSPECT HORSES AND ATTEND HGF EVENTS AT YOUR OWN RISK.
